Terms of sale – Arctic Chef AS

1. Parties
The seller is Arctic Chef AS, org. no. 912 172 910 MVA, Nordvarangerveien 1570, 9801 Vadsø, Norway, phone +47 415 17 809, e-mail post@anno1860.no. Orders are taken on anno1860.no.
The buyer is the person who places the order. These terms apply to consumer purchases. For businesses they apply where relevant, under the Sale of Goods Act instead of the Consumer Purchases Act.
2. The agreement
The agreement consists of these terms, the information in the order form and the confirmation you receive by e-mail. It is binding once you have sent the order and received the confirmation. When paying online, the order is confirmed once the payment has gone through.
3. Prices
All prices are in Norwegian kroner (NOK) and include 15 % VAT. Any delivery fee is shown before you send the order. There are no other fees. The total in the summary is what you pay.
4. Payment
You choose how to pay when you order:
• Pay now by card: payment is made through Stripe’s secure checkout and is charged when you order. You get a receipt by e-mail.
• Pay when collecting: you pay with Vipps, card or cash when you get the goods.
5. Pickup and delivery
The goods are collected or delivered on the day, time window and place you chose. The order deadline for each day is shown when you order. For delivery, someone must receive the goods, or you must tell us where to leave them.
The risk passes to you when you have received the goods. If we cannot deliver at the agreed time, we will tell you as soon as possible, and you can choose a new day or get your money back.
If the goods are not collected in the agreed time window and you have not let us know, we may claim our loss, as fresh goods cannot be resold.
6. Changes and cancellation
You can change or cancel free of charge until the order deadline for the day you chose. Contact us by phone or e-mail. If you paid by card, we refund the full amount to the card.
7. Right of withdrawal
The goods are fresh or frozen food that deteriorates quickly. Under the Norwegian Cancellation Act section 22 (d), the right of withdrawal therefore does not apply. You can still cancel until the order deadline, see section 6.
8. Returns
For food safety reasons we do not accept food back. If the goods are faulty, see section 9.
9. Complaints
If something is wrong with the goods, you have rights under the Consumer Purchases Act. Let us know as soon as you notice the fault – for fresh goods preferably the same day, ideally with a photo. We replace the goods or refund what you paid for them. Complaints are free of charge.
10. Allergens
Our products are made from fish and may contain other allergens such as milk, egg and gluten. The ingredients are listed on the packaging. Feel free to ask us before ordering if you have allergies.
11. Personal data
Name, e-mail, phone and any delivery address are used only to handle and deliver the order and to send the receipt. Receipts are kept for as long as Norwegian accounting law requires. Card details are handled by Stripe and are not stored by us. The data controller is Arctic Chef AS.
12. Disputes
Please contact us first on +47 415 17 809 or post@anno1860.no – we usually find a solution. If we cannot agree, the Norwegian Consumer Council (forbrukerradet.no) can help with mediation. Cases not resolved there can be brought before the Consumer Disputes Commission (Forbrukerklageutvalget).
